1. How do I file a small claims action against someone?

You will need to file small claims paperwork in the County Court. Information on how to file, as well as the paperwork needed, can be found on the Judicial Branch website.

2. Can I get an extension of time to pay my court costs?

3. Can I pay my traffic ticket/court costs by credit or debit card?

Our office does not accept credit or debit cards at this time. However, traffic tickets may be paid online. Pay Online

4. How do I get a copy of my court file?

Call the Wayne County Court at (402) 375-2260 to let them know which documents you need, and whether or not you need them certified. Some files are on microfilm, so advance notice is appreciated.

1. How do I get a U.S. passport?

You will need to fill out a passport application, which is available at the District Court office and online through the Department of State. You will also need to bring one passport photo, your original certified birth certificate, your previous passport (if applicable), photo ID, and two checks or money orders. Apply in person at the District Court Office at 510 Pearl Street in Wayne. Minors under the age of 16 must be accompanied by both parents. Please plan to arrive by 4:00 p.m. Monday - Friday (open at 8:30 am).

2. Do you have forms to complete when filing for divorce?

We suggest that you seek the advice of legal counsel. If you cannot afford an attorney, you may contact the Legal Aid Society at (877) 250-2016.

3. How do I find information about my child support, spousal support, or property settlement payments?

Contact the Nebraska Child Support Payment Center at (877) 631-9973 for questions about child support.

For other judgments, contact the District Court at (402) 375-2260.

4. Do you do civil or criminal records searches?

The District Court does not conduct record searches. We have a public access terminal and we can direct you to the records to be searched. Most records are open to the public.

5. How far back do your records go for the purposes of genealogy research?

1. How do I obtain a gun permit?

Firearm permits for residents of Wayne County are available in the Sheriff's Office at 510 Pearl Street in Wayne. Residents living within the City limits of Wayne must obtain firearms permits from the Wayne Police Department at 306 North Pearl Street in Wayne.

2. How do I find out if someone is a registered sex offender?

A list of all registered sex offenders can be found on the Nebraska State Patrol website.

3. What are the laws regarding child passenger restraint systems?

1. What is the last day we can pay our real estate or property taxes without accruing interest?

The first half is due by April 30 and second half is due by August 31. Interest will begin accruing on May 1 and September 1. Call the Treasurer's Office at (402) 375-2885 for more information.

2. What do I need to bring to obtain or renew my driver's license?

Please see the Nebraska Driver's Manual for details. Manuals are available at the Driver's Examiner Station or County Treasurer's Office in the Wayne County Courthouse at 510 Pearl Street in Wayne, or at any Law Enforcement Office.

3. Do you accept credit or debit cards?

Yes, the Treasurer's Office accepts debit and credit cards with the Visa or MasterCard logo. An additional fee will be charged for all credit or debit payments. Contact the Treasurer's Office at (402) 375-3885 for specific information.

Vehicle Titles

1. What types of equipment need to be titled?

All motor vehicles and trailers, including travel trailers, mobile homes and fold-down camping trailers must be titled. Motorboats manufactured after November 1, 1972 must also be titled. Farm trailers for non-commercial use or with a gross weight of 9,000 pounds or less are not required to be titled. Contact the Wayne County Treasurer at (402) 375-3885 for more information.

2. What are the fees for a Nebraska title?

3. I have signed off on a title on the wrong line. Can I cross it out and sign on the correct line?

No, any erasures or alterations void a Nebraska title. Because it is now a mutilated title, a duplicate title will have to be issued. Contact the Treasurer's office at (402) 375-3885 for information on how to obtain a duplicate title. Transferring a Title

4. Does my title need to be changed if I move to a different county in Nebraska?

No, Nebraska titles are valid throughout the state.

5. My title reads ‘or/and or.’ Do both owners have to sign off to transfer title?

Yes, Nebraska requires signatures of all owners that are on the face of the title.

6. I purchased a vehicle from a dealer and was told they send all the paperwork to the County Treasurer. How long should I wait for the documents to be received? Will you contact me when they arrive?

Give the dealer at least 10 working days to send the paperwork before you contact us. If we have not received the title documents, you may have to contact your dealer. The Treasurer’s Office will not contact you when your paperwork is received. You have 30 days in which to title, register and license a vehicle after purchase; however, please check with the Treasurer’s Office to correct any possible problems with the paperwork before that time period has expired. 7. Who is required to sign an application for title?

If a husband and wife are titling together, only one signature is required. If the vehicle is to be titled in more than one person’s name, and the owners are not married, signatures from all owners are required. Certificate of Title

8. Does Nebraska require a notary to transfer a title?

9. Can I get a duplicate title from any county in Nebraska?

Yes, a duplicate title can be issued in any county in Nebraska. All persons whose names appear on the face of the title must sign a completed duplicate title application. The exception to this is a lienholder, or a title held by husband and wife. All signatures must be notarized. The fee for a duplicate title is $14. 10. I have paid off the loan against my vehicle and have received the title back from the lienholder. Does the lien need to be released at the county level?

Yes, the original title should be taken (or mailed) to any County Treasurer’s office to have the lien released from the state system. There is no charge for a lien release.

11. My vehicle has an out-of-state title. Does it need to be inspected before being issued a Nebraska title?

Yes, the County Sheriff’s office must inspect each out-of-state vehicle. There is a $10 fee for each inspection. Vehicles that must be inspected include any vehicle or motorcycle with an out-of-state title, any vehicle with a Salvage Certificate of Title, dump trucks, grain trailers, assembled trailers, livestock trailers & tractors that are not pro-rated, semi-trailers, boat trailers if pulled by a truck or a non-pro-rated tractor. 12. What is required to attach a lien on a title?

We will need the original title, a signed copy of the security agreement or loan document between buyer and lienholder (with the vehicle’s description and VIN number), and the $7 fee. Lien Notations

13. I have a lien on my out-of-state vehicle and want to transfer the title to Nebraska. How can I get my title transferred?

Contact the Wayne County Treasurer at (402) 375-3885. We will need the name, address and fax number of your lienholder, the VIN of your vehicle, and your account number with the lienholder. We will notify the lienholder and request your title be sent directly to the Treasurer’s Office. Only the original title is acceptable. After this request, allow at least two weeks before calling the Treasurer’s Office to inquire if your title has arrived. Once we have received the original title, an inspection is required and the title with the lien attached will be issued. The original Nebraska title will then be mailed to the lienholder. A $17 fee will be assessed.

14. How is a salvage title issued?

If you purchased a vehicle with a salvage title, whether out-of-state or a Nebraska title, a vehicle inspection by the County Sheriff is required. A Nebraska salvage title will be issued to the new owner, and after the Sheriff’s inspection is performed, a previously salvaged title must be issued. Salvage Titles
